Introduction

Welcome to Alpaka Reisen. These Terms and Conditions govern your use of our services and website. By booking a tour with us, you agree to comply with these terms.  

Booking and Payment

  1. Booking Confirmation: A booking is confirmed when you receive a confirmation email from Alpaka Reisen.
  2. Payment Terms: A deposit of 50% is required upon booking, with the remaining balance due 30 days before departure.
  3. Accepted Payments: We accept payments via credit card, bank transfer, and other specified methods.
  4. Currency: All payments must be made in US dollars (USD) unless otherwise agreed upon. Payments in euros (EUR) and Swiss francs (CHF) are also accepted. A currency conversion fee of 2% to 3% will be applied to cover administrative costs and risks associated with exchange rate fluctuations. Any exchange fees from EUR and CHF to USD will be covered in the named price, ensuring no additional costs for currency conversion.
 

Cancellation and Refunds

  1. Customer-Initiated Cancellations:
    • More than 30 days before departure: Full refund minus 10% administrative fee. Note that any purchased tickets (e.g., train tickets, entrance fees) are non-refundable and must be paid in full after booking confirmation.
    • 30 to 15 days before departure: 50% refund. Note that any purchased tickets (e.g., train tickets, entrance fees) are non-refundable and must be paid in full after booking confirmation.
    • Less than 15 days before departure: No refund. Note that any purchased tickets (e.g., train tickets, entrance fees) are non-refundable and must be paid in full after booking confirmation.
  2. Company-Initiated Cancellations: In the event Alpaka Reisen cancels a tour, customers will receive a full refund.
  3. Force Majeure: No refunds will be given for cancellations due to force majeure events (e.g., natural disasters, political instability).
  4. Subcontractor Payments: Refunds for payments already made to subcontractors will only be issued if we receive a refund from the subcontractor, and will be subject to a 10% administrative fee on the refunded amount.
 

Consumer Rights

  1. Information Disclosure: Alpaka Reisen will provide clear and precise information about services, including itineraries, prices, and what is included.
  2. Customer Support: Our team is available to address any concerns or issues before, during, and after your tour.
 

Health and Safety

  1. Compliance: We comply with Peruvian health and safety regulations, including COVID-19 protocols.
  2. Customer Responsibility: Customers must adhere to health and safety guidelines provided by Alpaka Reisen.
  3. Insurance: It is recommended that customers obtain travel insurance that covers personal injury, medical expenses, and other potential risks.
 

Data Protection

  1. Data Handling: We comply with Peru’s Data Protection Law (Ley de Protección de Datos Personales), the General Data Protection Regulation (GDPR) for EU customers, and the California Consumer Privacy Act (CCPA) for US customers. Personal data will be handled securely and used only for booking and service purposes.
  2. Customer Rights: Customers have the right to access, rectify, delete, and port their personal data. For EU customers, you can withdraw consent at any time. For Californian customers, you can opt-out of data selling.
 

Liability

  1. Limitations: Alpaka Reisen is not liable for any loss, damage, injury, or inconvenience caused by circumstances beyond our control.
  2. Responsibility: Customers are responsible for ensuring they are physically fit for the tour and have all necessary documentation (e.g., passports, visas).
 

Legal Jurisdiction

  1. Governing Law: These Terms and Conditions are governed by the laws of Peru.
  2. Dispute Resolution: Any disputes arising from these terms will be resolved under Peruvian jurisdiction.
  3. International Compliance: For EU customers, these terms comply with the General Data Protection Regulation (GDPR). For USA customers, these terms comply with relevant federal and state laws, including the CCPA. For Swiss customers, compliance with Swiss payment regulations.

  1. Changes to Terms: Alpaka Reisen reserves the right to update these Terms and Conditions at any time. Continued use of our services constitutes acceptance of the updated terms.
